Terms for the DV Lottery Alert monitoring and notification service.

1. Provider and scope
The service is provided by Maximilian Braun, Burgstallgasse 10, 93309 Kelheim, Germany. These terms apply to the free X-post email alert for DV-2027.
2. The service
We periodically check a limited set of public U.S. Department of State sources. After a conservative confirmation process, we send one email alert. We do not submit DV entries, provide immigration advice, determine eligibility, reserve places, or increase selection chances.
3. Contract formation
A contract is formed when the required X post and email verification have been submitted and we confirm activation of the alert.
4. Price
No monetary payment or subscription is currently required. The conditions for activating the free alert are described in section 7.
5. Performance and term
Monitoring begins after activation and continues until registration for the specified DV year has opened and the alert has been processed, or until official information makes the service objectively obsolete. You expressly request that monitoring begin during the statutory withdrawal period. Your withdrawal right ends only when the service has been fully performed and the legal requirements for early expiry are satisfied.
6. Your responsibilities
Provide a working email address, keep it accessible, and check spam filtering. You remain solely responsible for checking official rules and submitting any entry through the official government system.
7. Free X-post option
The free option requires one public X post containing the supplied site link and a plain statement that the alert is provided free in exchange for sharing the link. You must submit the exact public post URL and verify your email. One free alert is available per person and DV year, and each post URL may be used once. The post must be accessible when the claim is checked. Duplicate identities, unrelated or inaccessible posts, missing required information, automated submissions, and manipulation do not qualify. We may review claims and reject objectively abusive or non-qualifying submissions.
8. Availability and delivery
We use reasonable care, conservative detection, and retries. Government pages, networks, email providers, and other third-party services can fail or change without notice. We do not promise uninterrupted monitoring or delivery at a particular minute. Where mandatory consumer law applies, these limitations do not remove statutory rights.
9. Liability
We are liable without limitation for intent, gross negligence, injury to life, body or health, fraudulent concealment, guarantees expressly given, and mandatory statutory liability. For slight negligence affecting an essential contractual duty, liability is limited to foreseeable, typical loss. Otherwise, liability for slight negligence is excluded to the extent legally permitted.
10. Defects and complaints
Statutory rights for defective services and digital products remain unaffected. Send complaints to info@dvlotteryalert.com. We are not willing or obliged to participate in consumer arbitration proceedings.
11. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory protections of your habitual country of residence remain unaffected. Statutory jurisdiction rules apply.
